Discuss the disparity between the “letter of law” and the “spirit of law” in specific instances.

Agency can be defined as the relationship which arises when one person (called the agent) acts on behalf of another person (called the principal) and has authority in law to affect the principal’s legal position with regard to a third party. (Study Text Irish Business Law ch 14 pp159).
Agency is central to commerce and without it modern commerce would be seriously hampered, for example a man starts a business he as to acquire premises and plant, buy materials, hire staff, sell products, to do all this things many contracts have to be made and it would be physically impossible for him to make all the contracts on his behalf, theses others persons are called agents, if the business prospers he may take in partners in which case each partner will be an agent for the others in running the business or, he may decide to form a limited company, and since a company is an artificial person it can only do business through agents i.e. the staff of the company, and ‘outside’ ag...
