He hears everyone's side of the story before making a decision. This is evident in the novel because he is Tom Robinson's lawyer and does not car that he is black. He also treats Calpurnia like one of the family. You can see that Atticus is fair and equal after Jem and Scout are attacked and Bob Ewell is dead. He does not want Tate to give Jem special privileges just because he is Atticus' son. "If this thing's hushed up it'll be a simple denial to Jem of the way I've tried to raise him." (273) He does not want to be a hypocrite.
