Surrogacy Evaluations

Why do surrogacy laws differ from state to state? Why are there no existing surrogacy laws on the federal level? One explanation of the lack of policies could be the fact that states have varying opinions and ideas. For instance, Arkansas allows and enforces surrogacy contracts and grants parental rights solely to the intended parents (http://
www.fertilityhelp.com/laws.htm). In contrast, Arizona prohibits contracts and grants parental rights to the surrogate mother (http://www.hrc.org/familynet/adoption_
laws.asp). What direction should Louisiana take? Louisiana has very few surrogacy policies enacted. The first law allows surrogacy contracts but will not enforce it. The second law prohibits anything of monetary value to be exchanged in the process (http://www.kylewood.com/family
law/babym.htm). Assessing and evaluating prospective laws in effect in other states should be the first.
