New York State Society of Certified Public Accountants v. Eric Louis Associates, Inc.

The New York State Society of Certified Public Accountants (NYSSCPA) is a not-for-profit corporation. It has eleven local chapters in New York and over thirty thousand members. The NYSSCPA is a place for accountants to share information with each other about the profession and also to maintain high standards with regard to practice. Since 1984, the NYSSCPA had been using the servicemark ‘NYSSCPA’ to identify its organization and did not allow any authorization for anyone else to use the mark. The mark appears on the company’s brochures, hats, pins, mugs, shirts, and other items, which are given to its members. In 1994, the NYSSCPA registered the domain name http://www.nysscpa.org and operated its website there. The website provides information about the company’s news stories and press releases.
