Facts:
Town & Country (T&C) is a non-union electrical contractor. They have advertised, through an employment agency, several openings for electricians on a construction job in Minnesota. Town & Country refused to interview 10 out of the 11 union applicants that applied, which included two professional union staff. The one union applicant that T&C hired through the employment agency was fired after a couple of days on the job. Local 292 and 343 filed a complaint with the NLRB against T&C. The members the union complained that T&C did not interview or retain them because of their union membership. The judge ruled in favor of the union and the Board affirmed the decision. Town & Country appealed the decision.
