Legal Process Outline
This paper will discuss the Equal Employment complaints process as well as the civil litigation process.
If someone believes that they have been discriminated against as an employee, a former employee, or an applicant for employment, because of race, color, religion, sex, national origin, age, or disability. That person has a right to file a complaint with a designated EEOC Counselor at his or her job, or contact his or her local EEOC office. However, there is a process to one must follow to make sure the complaint is filed correctly.
First, that person has 45 days from the date of the incident, to contact an EEO counselor. The counselor then has 30 days from the time you report the incident, to attempt an informal resolution of the matter. If, however, you give the counselor written permission, then the 30 days may be exten...
