Proving Discrimination
Proving discrimination is a burden. The burden of proof is mandatory if a case is to be won. Many areas must be reviewed and researched in order to form a successful case against an employer. How is discrimination proved? A basic guide describing how discrimination is proved will involve addressing many issues. Previously tried cases will preside over the decisions of today’s courts, judges, and lawyers. New circumstances will allow for new decisions and the evolution of proving discrimination will continue to grow. In my paper I will address the following issues describing how discrimination is proved: Employer/employee position, protected class, employment action, legitimate reason, statistical data, applicable statutes, and disparate treatment and disparate impact. It is my attempt to inform the reader as well as educate myself of the processes. I will focus the research on age discrimination.
