Factual and Legal Background. On March 9, 1965, the Federal Power Commission granted a license to the Consolidated Edison Company of New York, Inc. to construct a pumped storage hydroelectric project on the west side of the Hudson River at Storm King Mountain in Cornwall, New York. The pumped storage plant would generate electric energy for use during peak load periods, using hydroelectric units driven by water from a headwater pool or reservoir. The Scenic Hudson Conference, a conservationist group, was opposed to the project, claiming that it was located in an area of unique beauty and major historical influence.
