I. Facts

On March 20, 1983, Marybeth Atkins sustained a serious injury while skiing at Jiminy Peak Ski resort. It was affirmed that her injuries were caused from defective ski equipment that she had rented from the rental facility at the resort. She stated that the equipment was not inspected or adjusted, resulting in negligence and breach of contract. On December 5, 1984, Atkins filed a complaint against Jiminy Peak, Inc. in the Massachusetts Supreme Judicial Court.
