Introduction
An employee believing that they have been discriminated against because of race, color, sex, religion, national origin, age, or disability may file a charge with the Equal Employment Opportunities Commission, further noted as the EEOC. When the charge is first received it is classified and notices are sent to the employer or responsible party accused of discrimination. From there the decision to mediate, conciliate, or in some cases litigate is made. Since the passing of the Civil Rights Act of 1991 the possibility of monetary damages has made it far more likely for employers to settle rather than risk large damage awards. Most of these costly litigation proceeding with the EEOC can be avoided by ensuring that solid workplace policies are in place.
